CONDITIONS OF SALE 1. The highest bidder shall be the buyer and the auctioneer's decision is final in any dispute arising. Any dispute shall be settled at the auctioneer's absolute discretion. Under no circumstances will a sale be cancelled. 2. The auctioneer has absolute discretion to refuse, cancel and regulate bids. Commission bids will be executed at the lowest possible price, subject to competing bids and reserves. The auctioneer cannot be held liable for any failure or neglect to execute a bid. Once a bid has been made it cannot later be cancelled without the agreement of the auctioneer in writing. 3. All lots put up for sale may be subject to a reserve imposed by the seller. Estimated selling prices suggested by the auctioneer are for guidance only and should not be taken as a true value or guarantee of the actual price a lot will sell for. They are the auctioneers opinion only. 4. All descriptions of lots will be undertaken by the auctioneer and these descrptions will be the opinion of the auctioneer only. Each lot is believed to be genuine [unless stated] but should any lot prove not to be, the buyer may return the lot in its original condition within 21 days of the sale date. Under no circumstances will returns be accepted after 21 days. Any prospective buyer should satisfy themselves as to the accuracy of descriptions before bidding. 5. The buyer shall pay to the auctioneer a buyers premium on the 'highbid' hammer price at the rate current at the time of the auction [see 'bidding' page], together with any applicable VAT at the prevailing standard rate thereon, if applicable. ARR 4% [artists resale rights] may also be payable on work by living artists selling for 1,000 euros or more [or the £ sterling equivalent]. 6. Condition reports can usually be provided, but in all cases these are only the opinion of the auctioneer. Lots described specifying defects may not be rejected due to these defects or any other defects. The buyer should satisy himself as to condition and all defects prior to bidding. 7. Purchased lots shall be at the buyers risk in all respects from the auction end and neither the auctioneer or their agents shall be responsible for any loss or damage of any kind, whatever the cause. 8. E-mail and postal bidders should be aware that these methods are not totally reliable or secure and the auctioneer will not be responsible for any lost, delayed or altered bids. 9. Successful postal or e-mail bidders will receive a statement of account as soon as possible after the sale. The full remittance including delivery charges should be forwarded within 7 days. Cheques will need to be cleared, which will normally take up to 7 days. Proof of address may be required prior to payment acceptance. Lots will be forwarded to buyers at the auctioneer's earliest convenience. No lots will be forwarded to buyers until they are paid for in full. 10. The auctioneers only act as agents between the seller and buyer and will not be liable for any dispute which may arise between them. 11. Payment of sale proceeds, less all applicable charges, will be forwarded to sellers within 28 days after the auction date, provided payment has been received from the buyer. The auctioneer will not be responsible for buyer non-payment. A sellers commission at current rates [see 'selling' page] will be deducted together with any applicable VAT and other relevant charges. 12. Any person bidding for a third party will be fully liable for any purchases. 13. Sellers are responsible for keeping their goods fully insured at all times. The auctioneer will not be responsible for the insurance of lots, unless there is a prior agreement regarding insurance and an insurance cover fee has been paid. 14. By making a bid the buyer acknowledges his acceptance of these conditions and is bound by them. 15. The auctioneers reserve the right to add to or adjust these conditions at any time without prior notice.
